Processing the Complaint

Once a complaint has been filed against you, there are several steps that the complaint must go through before it reaches a Disciplinary Review Panel and becomes a case. When a complaint is filed, it must go through the following process:

  1. The complaint must first be reviewed to ensure that it qualifies as a legitimate complaint.
  2. If the complaint is determined to be legally sufficient, steps are taken to investigate the complaint. The complainant must be notified of the complaint and then respond within 30 days before the investigation can move forward.
  3. Once the investigation is complete, one of two things will happen. If probable cause cannot be determined, the complaint is sent to the Dismissal Committee who decides to either refer it for dismissal or to Enforcement. If, on the other hand, probable cause can be determined, it is sent to the Disciplinary Review Panel. No matter which action is taken, the complainant is notified of the decision in writing.
