Peer Review Actions

The findings of a hospital peer review have the potential to negatively affect a medical professional’s licensure and practice. Peer reviews are conducted by other hospital staff to investigate a physician’s behavior and practice methods. If the investigation yields negative results, the hospital must report these findings to the Texas Medical Board (TMB), which may then initiate its own investigation. Clearly it is in a physician’s best interest to receive a positive peer review and immediately contest any potentially detrimental findings.

Defending Against a Peer Review

All medical staff members are required to follow the by-laws of the hospital at which they work. These rules vary slightly from hospital to hospital, but typically include the definition of a certain standard of care, behavioral requirements, and conditions of malpractice. If a peer review finds that a health practitioner has committed a violation of the by-laws, he or she may be subjected to disciplinary action and reported to the TMB. The complex procedures and laws involved in a license investigation require a well-prepared defense to minimize the chance of disciplinary action.
