Confidential Rehabilitation Order as an Alternative to Public Discipline
When a medical physician is charged and convicted of crimes relating to drug possession and use, these accusations take a toll on their personal and professional lives. Public discipline of these actions has to be reported to the National Practitioner Database. Their license to practice medicine could be evoked, meaning they are no longer able to find a job and support their family. Luckily, an alternative is available to medical professionals suffering from drug addiction, alcohol addiction, or mental health problems. Confidential rehabilitation orders, also known as private orders, provide physicians a way to seek help and treatment for their addictions or other troubles while avoiding the harm public discipline would cause to their practice. A confidential rehabilitation order is not available for the public or potential future employers to see, so there is no way it should harm a physician’s practice or reputation.
If you or someone you love is a physician suffering from addiction or mental health problems, talk to a medical license attorney about the possibility of a confidential rehabilitation order. Eligibility for this order is under complex regulation, but an experienced attorney can walk you through the process and advise you about the actions you need to take in order to be considered for the order. The attorneys at the Leichter Law Firm PC work with a vast number of physicians every year. We employ all of our resources to protect the licenses of working medical professionals. Our compassionate attorneys understand that your practice means everything to you, and we are devoted to fighting for your reputation.
Issuing a Private Order
The Texas Medical Board considers all aspects and circumstances of each individual case when determining whether a private order is appropriate. With that in mind, the board focuses on a few particular circumstances. These circumstances include the following:
- The licensee’s use of drugs or alcohol is a direct result of addiction caused by medical treatment
- The licensee’s self-reported use of drugs or alcohol has not previously been the subject of a substance abuse-related order of the board
- A court has determined that the licensee is of unsound mind
- A mental or physical examination has determined that the licensee has an impairment
- The licensee admits to suffering from an illness, physical condition, or mental condition that limits the person’s practice of medicine
Issuance of a private order grants physicians the ability to get treatment for their problems, and it protects the public from receiving treatment from a potentially unfit physician. The order allows you time to recover and get back to practicing medicine at your usual level.
