Podiatrists
The practice of podiatry is regulated and monitored by the Texas State Board of Podiatric Medical Examiners. The regulations governing podiatrists are codified in Texas Occupation Code § 202 and the Board of Podiatric Medical Examiner’s Rules promulgated in Title 22 Part 18 of the Texas Administrative Code.
The Board of Podiatric Medical Examiners may reprimand, place on probation, suspend or revoke a podiatrist’s license for a violation of the law which relates to the practice of podiatry or a Board Rule, Texas Occupations Code § 202.501. Possible offenses include:
- Conviction of a drug related felony (Texas Occupations Code § 202.501);
- Sexual misconduct (22 Texas Administrative Code § 375.33);
- Violation of the hyperbaric oxygen Guidelines (22 Texas Administrative Code § 375.5); or
- Nitrous Oxide/Oxygen Inhalation Conscious Sedation Guidelines (22 Texas Administrative Code § 375.3).
The complaint and investigation process is administered by the Texas State Board of Podiatric Medical Examiners to detect, monitor and discipline violations and misconduct, Texas Occupations Code §§ 202.201 – 202.205. Before the Board may impose discipline, the podiatrists has a right to an Administrative Hearing to resolve the contested case pursuant to Texas Occupations Code § 202.555 and Chapter 377 of the 22 Texas Administrative Code.
